Last week, judge Analisa Torres made a partially summary judgment on the institutional sale of XRP tokens. It parted partly on the side of the SEC and partly on the side of Ripple in terms of programmatic sales. Although the case is still being negotiated in court, industry experts consider the decision largely as a great triumph for Ripple and other token issuers. In the current process, some important questions still have to be clarified. This also includes the question of the punishment that Ripple may have to pay for his former institutional sales. The SEC could make an appeal against the partial judgment, but the claim of judge Torres complicates that programmatic sales are not securities, other accusations in the case, says Schultz. In its first complaint, the SEC accused the Ripple founder and former CEO Christian Larsen as well as the former Chief Operating Officer and current CEO Brad Garlinghouse for violations of securities laws. Apart from that, the SEC has lost against Ripple and the managers, explains Schultz.
