Elon Musk's lawyers reject complaints from Dogecoin investors and refer to them as a waste of time by the court
Elon Musk's lawyers defend themselves against the proposal of a group of Dogecoin investors to remove them from the case. The plaintiffs accused the lawyers of showing inappropriate behavior. Musk's lawyers described the application as a "insult" and a waste of time of the court.
In a 17-page submission, Musk's lawyers rejected the plaintiffs' allegations. They explained that the allegations, including the claim that Musk lawyer Alex Spiro had given the press a derogatory letter, were unfounded and that the legal "laughter" had not passed. This legal teaching takes into account the severity of a claim.
Musk's lawyers emphasized that the plaintiff's allegations are "absolutely nothing funny" and that it is instead the plaintiff lawyer Evan Spencer who had behaved inappropriately. They claimed that Spencer's application was so inappropriate that it should be sanctioned himself.
The application of Spencer was made on June 26 and accused Musk's lawyers to have shown a pattern of degrading and oppressive behavior. In particular, Spiro was accused of using dirty tactics by supposedly causing a letter to the press to seep through in which he degraded his competence.
Spencer also asked the judge, Allison Huebert, a lawyer of Tesla, to dismiss because of a supposed conflict of interest. He demanded that Musk to be financially punished for their behavior.
Musk's team rejected the allegations and explained that Spencers allegations were unfounded. Even if they were true, this does not violate ethical rules that prohibit communication with the press.
The lawyers also argued that New York law would allow the simultaneous representation of managers and their companies. They described Spencer's argument as a "imaginative invention".
The judicial dispute between Elon Musk and the Dogecoin investors began in June last year. The plaintiffs accuse Musk of being part of a blackmail plan in favor of cryptocurrency. Musk denies any misconduct and emphasizes his interest in Doge.
It remains to be seen how the judge will react to the applicant's request and how the court dispute will continue.
