  • The law firm has argued that Roche's comments should not exclude it from the litigation against crypto companies

Roch Freedman, the law firm, which is behind several lawsuits against crypto companies, is in the damage limitation mode after founding partner Kyle Roche has been accused of accepting payouts to damage actors in the industry.

The law firm asked a judge of the New York Federal Court of Justice on Friday to reject applications from Tether and Bitfinex, to disqualify them as a co-lead country in their ongoing class action, and said that the complaints of a lawyer should not have any consequences for the entire practice.

Roche supposedly closed a secret pact with the Avalanche developer Ava Labs to use litigation as a weapon against its competitors. In secretly recorded videos published by Cryptoleaks, he admitted to being the internal crypto expert from AVA Labs and being responsible for the fact that the US stock exchange supervisory authority remains distracted by other goals.

Roche claims Information in the Cryptoleaks report are wrong and contained. However, his law firm informed the court that the lawyer had "unfortunately" provided untrue information to impress the participants.

"He also made inappropriate remarks in which he reduced jury and class members," said Roche Freedman.

Shortly after the synopsis and although Roche contested the accuracy of the alleged conspiracy, Roche applied for his resignation as a lawyer for several collective suits that he had initiated against companies such as Tether, Bitfinex, Binance, Solana Labs and Dfinity - the latter two competitors from AVA Labs.

In the lawsuits of Roche Freedman, it is claimed that the respective tokens by Solana Labs and Dfinity, Solana and Internet computer are not registered securities. The company's dfinity lawsuit also claims cases of insider trade.

According to Roche Freedman, the Tether case, Bitfinex was not submitted for AVA Labs

Some defendants consider the withdrawal of Roche from the procedure to be unsatisfactory. Tether and Bitfinex have demanded that the entire company be removed from their case and explains that other Roche Freedman lawyers are known to have significant amounts of Avax token.

As an answer, Roche Freedman said that Roche was no longer part of the company's collective action practice and did not have his financial interest in the legal dispute against Tether and Bitfinex, in which the companies are accused of being involved in market manipulations to increase token prices.

The company also claimed that the Tether/Bitfinex case was not submitted by AVA Labs on request and that the partner interest in AVA Labs or Avax-token is not a conflict of interest. It was said that the case had been submitted before the relationship between Ava Labs and the company began.

A declaration of intent, however, shows that a financial agreement between the two parties began on September 30, 2019 - about a week before the case in question filed on October 6, 2019 by Kyle Roche and Velvel Freedman.

The lawyer of Tether and Bitfinex, Elliott Greenfield, did not answer the request of block works for comment.

Roche Freedman continued to argue that AVA Labs was not a competitor of the sued parties - and even if this were the case, there would be no disqualifying conflict.

"The idea that the company submitted this case for AVA Labs is therefore impossible, nonsensical and wrong," said Roche Freedman.
